1. Terms of Use

The Online Order Form is made available to you by CityLink Motors Pty Ltd, Trading as CarsThatExcite.au (ABN 18 098 223 271), for the purpose of enabling you to:

(a) Browse our vehicles via our website;

(b) Indicate to us your interest in purchasing one of our vehicles;

(c) Pay us a holding fee to hold a vehicle for a minimum of 3 business days while you negotiate the purchase terms with us.

2. Acceptance of Terms of Use

By using the Online Order Form, you accept and agree to these Terms, which set out our obligations to you and your obligations to us about using the Online Order Form.

3. Vehicle Availability

Submitting an Online Order does not automatically imply the availability of the vehicle, as the vehicle may have been or maybe in the process of being sold offline. The vehicle availability is subject to confirmation by us on receipt of your Online Order (including payment of the $1,000 holding fee).

4. Online Order Process

Following your submission of an Online Order, the following process will occur:

(a) A team member will contact you shortly after completing the online order, subject to the time of your submission. They will confirm:

The details of your online order;

Your vehicle’s availability, and advise you of the next steps and answer any questions you may have regarding the purchase of your vehicle.

(b) Upon receipt of your $1,000 holding fee;

(i) If your selected vehicle is available, you will receive your purchase documents electronically for your review. The documents will show your $1,000 holding fee;

(ii) We will hold your selected vehicle for three business days from the time that you submitted your Online Order via the Online Order Form. If you require more time to negotiate the final sale price, trade-in value, or finance options, you may request an extension of the holding period. You can do this by speaking with one of our customer care team members. Alternatively, email customercare@carsthatexcite.au

(iii) If you decide to proceed with the purchase, we will deduct $1,000 from the purchase price;

(iv) If at any time prior to entering into a purchase agreement you decide not to proceed with the purchase, we will issue a full refund of your $1,000 holding fee and release the hold on your selected vehicle;

(v) If your selected vehicle is not available, we will issue you with a full refund of your $1,000 holding fee;

5. Not an Agreement to Purchase

(a) Nothing in these Terms forms an agreement arising after using the Online Order Form, including purchasing a vehicle;

(b) If you decide to enter into a sales contract, the sales contract will set out all the terms and conditions of your vehicle purchase.

6. Pricing

Pricing of the vehicles listed on our website is subject to the following:

(a) Our list price is based on the year model, odometer reading, colour, condition, features, and additional options, as available for sale.

(b) The list price excludes government charges and statutory charges. Government and statutory charges may vary according to the State or Territory of the vehicle registration due to differences in price components such as stamp duty or registration fees.

7. Privacy Collection Statement

By using the Online Order Form, you agree and accept that we will collect your personal information, such as your name and contact details. Your personal information will be collected and stored in accordance with the terms of our Privacy Policy. Failure to provide your personal information may prevent the completion of your Online Order. We may disclose your personal information to third parties, such as financial institutions, service providers, or as the law requires. 8. Disclaimers

While every effort has been made to ensure that the information included in the Online Order Form is correct and up to date, some inaccuracies may be present, and CityLink Motors Pty Ltd, trading as CarsThatExcite.au makes no representations or warranties as to the accuracy of the images or information included in the Online Order Form.

This website is provided as a convenience to you on an as-is and as available basis. We do not warrant that your access to the website pages will be uninterrupted or error-free.
